AGREEMENT - TERMS AND CONDITIONS OF PARTICIPATION

1. Agreement to Terms

This Agreement is entered into between the Parent or Legal Guardian (Parent) and FlowscapeStudio, a subsidiary of Maisonine Inc (the Company). By registering a child for any camp,workshop, PA Day program, birthday party, or event (Services), Parent agrees to be legally boundby this Agreement.

2. Eligibility

Services are available only to children between five (5) and twelve (12) years of age who will be five(5) years old on or before the first day of service.

3. Term

This Agreement applies to each child registered for the selected program and automaticallyterminates at the conclusion of the registered program.

4. Health, Illness and COVID-19 Policy

A child must not attend if experiencing fever, vomiting, diarrhea within 24 hours, contagious illnesssymptoms, untreated lice, or other communicable conditions. If a child becomes ill during Services,Parent or the emergency contact listed will be notified immediately. Participants who test positivefor COVID-19 shall not attend. Siblings residing in the same household may also be restricted.COVID protocols may change in accordance with Ministry or public health guidance.

5. Emergency Authorization and Consent to Treatment

If Parent or emergency contact listed cannot be reached and urgent care is required, Parentauthorizes the Company to seek medical treatment, call 911, and arrange transport. Parentassumes full financial responsibility for medical services rendered.

6. Payment Terms and Refund Policy

Workshops and PA Days:Full payment is due at booking. Payments are non-refundable.Camps (Summer and March Break):Full payment is due at booking. Refund permitted with minimum fourteen (14) days written notice,subject to a $25 administrative fee. No refund after that period or once camp has commenced.Birthday Parties:$100 non-refundable deposit required at booking. Remaining balance is due three (3) days prior tothe event to confirm the booking.Non Sufficient Funds (NSF):Returned payments due to Non Sufficient Funds incur a $45 administrative fee.

7. Late Pick-Up Policy

Programs conclude at the designated time. Pick-up after closing will result in a $10 fee per child upto five (5) minutes late. Thereafter, a charge of $1 per child per minute applies. If no contact ismade, the emergency contact may be notified after fifteen (15) minutes.

8. Child Release

Children will only be released to the Parent, emergency contact listed, or a pre-authorized individualidentified in writing. Government-issued photo identification is required for all authorized pickups.

9. Behaviour Policy

The Company reserves the right to remove any child for unsafe, disruptive, or aggressivebehaviour. No refund will be issued in such circumstances.

10. Media Consent

Parent consents to the capture and use of the child's image, voice, or artwork for promotional andmarketing purposes without compensation, unless Parent opts out in writing.

11. Consent to Commercial Electronic Messages

In accordance with Canada's Anti-Spam Legislation (CASL), Parent consents to receivecommercial electronic communications regarding programs and events. Parent may unsubscribe atany time using the provided unsubscribe link.

12. ASSUMPTION OF RISK, RELEASE OF LIABILITY ANDINDEMNIFICATION

Parent EXPRESSLY AND VOLUNTARILY ASSUMES ALL RISKS associated with participation,including risks of PERSONAL INJURY, SERIOUS INJURY, ILLNESS, PROPERTY DAMAGE, ORDEATH, INCLUDING RISKS ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES.Parent WAIVES, RELEASES, AND FOREVER DISCHARGES Maisonine Inc, Flowscape Studio,and their affiliates from all claims INCLUDING CLAIMS ARISING FROM NEGLIGENCE, BREACHOF CONTRACT, BREACH OF STATUTORY DUTY, OR DUTIES OWED UNDER THEOCCUPIERS LIABILITY ACT (ONTARIO), to the fullest extent permitted by law. UNDER NOCIRCUMSTANCES SHALL THE RELEASED PARTIES BE LIABLE FOR INDIRECT,INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES. TOTALCUMULATIVE LIABILITY SHALL NOT EXCEED A TOTAL AMOUNT OF $10 CAD.

13. Indemnification

Parent agrees to indemnify and hold harmless the Company from any claims, including third-partyclaims or claims brought after the child reaches majority, and agrees to cover legal costs on asubstantial indemnity basis.

14. Limitation of Liability

The Company shall not be liable for indirect or consequential damages beyond the cap statedabove.

15. Force Majeure

The Company shall not be liable for cancellation or suspension due to severe or excessivelyinclement weather, public health advisories, government directives, labour disputes, utility failure, orevents beyond reasonable control. Any refunds in such circumstances shall be at the solediscretion of the Company.

16. Personal Information

Personal information is collected for program administration and handled in accordance with theCompany's Privacy Policy.

17. Severability

If any provision of this Agreement is found unenforceable, it shall be severed or modified to theminimum extent necessary and the remaining provisions shall remain in full force and effect.

18. Governing Law

This Agreement shall be governed by the laws of Ontario and applicable federal laws of Canada.The parties irrevocably attorn to the jurisdiction of the Courts of Ontario.
